USER AGREEMENT

1. Terms and definitions.

1.1. In this offer, unless the context requires otherwise, the following terms have the following meanings and are an integral part of it:

Seller-LLC”Craft and Art” (address:Uzbekistan, Tashkent, 74 Dombirabad street) 100181 B/ A: 2020 8000 5008 5144 5004, AO “Ravnaq-Bank” Uzbekistan Tashkent street Furkat 2 100021, MFO 00980, TIN 303361884, OKED 46760).

Buyer — any natural or legal person who has accepted a public offer under the terms of this offer.

Online store — the official online store of the Seller LLC “Craft and Art”, located at the Internet address https://www.Uzcrafts.uz Within the framework of this agreement, the concepts of Online Store and Store, as well as Internet addresses https://www.Uzcrafts.uz and derived from https://www.Uzcrafts.uz they are equivalent and are interpreted authentically, according to the context of the offer.

The product is the object of the agreement of the parties, the list of names of the assortment presented in the official online store of LLC”Craft and Art” at the Internet address https://www.Uzcrafts.uz

2. General provisions.

2.1. This public Offer (hereinafter referred to as the Contract) is an official offer of LLC”Craft and Art” to any natural or legal person who has the legal capacity and the necessary authority to conclude a contract of sale of Goods with LLC”Craft and Art” on the terms defined in this offer and contains all the essential terms of the contract.

3. The subject of the Contract and the price of the Goods.

3.1. The Seller transfers, and the Buyer accepts and pays for the goods on the terms specified in this agreement. The right of ownership of the Ordered Goods passes to the Buyer from the moment of the actual transfer of the Goods to the Buyer and the payment of the full cost of the Goods by the latter. The risk of accidental loss or damage to the Goods passes to the Buyer from the moment of the actual transfer of the Goods to the Buyer. By signing in the courier’s list, the Buyer confirms the acceptance of the goods.

3.2. The prices for the Goods are determined unilaterally and indisputably and are indicated on the pages of the online store at the Internet address: https://www.Uzcrafts.uz

3.3. The price of the product is indicated in the world currency of the United States-the dollar.

3.4. The offer to conclude a contract for a specific product is valid for the duration of the product’s stay on the Seller’s website.

3.5. The product is presented on the website through graphic images-samples that are the property of the online store.

3.6. Due to the different technical characteristics of the monitors, the color of the Product may differ from the one shown on the website.

3.7. The appearance of the Product may differ from that described on the website.

3.8. At the request of the Buyer, the manager of the online store is obliged to provide (by phone, by e-mail or other electronic means of communication) the information necessary and sufficient, from the point of view of the Buyer, to make a decision on the purchase of the goods.

4. The moment of conclusion of the contract.

4.1. The text of this Agreement is a public offer (in accordance with Part 2 of Article 369 and Article 426 of the Civil Code of the Republic of Uzbekistan).

4.2. The Contract concluded on the basis of the Buyer’s acceptance of this offer is a contract of accession to which the Buyer joins without any exceptions and/or reservations.

4.3. The fact of placing an order by the Buyer is an unconditional fact of the Buyer’s acceptance of the terms of this Agreement. The buyer who purchased the goods in the Seller’s Online store (who placed an order for the goods) is considered as a person who entered into relations with the Seller under the terms of this Agreement.

5. Rights and obligations of the parties.

5.1. The Seller undertakes to:

5.1.1. From the moment of conclusion of this Agreement, to ensure in full all obligations to the Buyer in accordance with the terms of this agreement and the current legislation. The Seller reserves the right to default on the obligations under the Contract in the event of force majeure circumstances specified in paragraph 9 of this Agreement.

5.1.2. Process the Buyer’s personal data and ensure their confidentiality in accordance with the procedure established by the current legislation.

5.2. The Seller has the right to:

5.2.1. Change this Agreement, Product Prices and Tariffs for related services, methods and terms of payment and delivery of goods unilaterally, placing them on the pages of the online store located at the Internet address: https://www.Uzcrafts.uz All changes take effect immediately after publication, and are considered to be brought to the attention of the Buyer from the moment of such publication.

5.2.2. Record telephone conversations and maintain electronic correspondence with the Buyer. The Seller undertakes to: prevent attempts of unauthorized access to information and / or transfer it to persons who are not directly related to the execution of Orders; to detect and prevent such facts in a timely manner.

5.2.3. Without the consent of the Buyer, transfer their rights and obligations to perform the Contract to third parties.

5.2.4. Refuse to execute the completed order if the data provided by the Buyer does not allow for its unambiguous identification.

5.2.5. In case of detection or existence of grounds to believe that the payment was made as a result of fraudulent actions of third parties, the Seller reserves the right to fulfill the obligations under the order within 90 calendar days, and upon confirmation of the fact of fraud, cancel the acceptance of the order and payment.

5.3. The Buyer undertakes to:

5.3.1. Prior to the conclusion of the Contract, read the content and terms of the Contract, the prices of the Goods offered by the Seller in the online store, as well as other terms and conditions on the pages of the online store located at the Internet address: https://www.Uzcrafts.uz

5.3.2. In order to fulfill the Seller’s obligations to the Buyer, the latter must provide all the necessary data that uniquely identifies him as the buyer and is sufficient to deliver the Goods ordered by him to the Buyer, provided that the goods are delivered.

5.3.3. Pay for the ordered Goods and their delivery under the terms of this agreement.

5.3.4. In order to avoid disputes, when placing an order, read the information offered by the Seller on its website.

6. Product delivery

6.1. Delivery to the Buyer is carried out within Uzbekistan and other countries of the world under the conditions specified in the section “Payment and delivery”.

6.2. To ensure the safety of the presentation, each order is packaged and delivered in transport packaging (polyethylene, polypropylene bag with handles and without).

7. The conditions of return and exchange of goods

7.1. Goods of good quality

7.1.1. The buyer has the right to refuse the ordered goods of proper quality without explaining the reason at any time: before its receipt, at the time of delivery of the goods by courier, as well as after receipt-within 10 days. The return or exchange of the product is possible when: its presentation (packaging, seals, labels), consumer properties, as well as a document confirming the fact and conditions of purchase of the specified product (product or cash receipt) are preserved. The goods of proper quality are not subject to return ()The offer is developed in accordance with the Civil Code of the Republic of Uzbekistan, the laws of the Republic of Uzbekistan “On electronic Commerce”, “On electronic document management” and other regulatory legal acts and regulates the implementation of the sale of goods in the form of electronic commerce, presented in the Trading Platform “Unisavdo”.
Retail trade carried out in the form of electronic commerce is regulated by the Regulations on the procedure for carrying out retail trade activities, approved by the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 407 of November 26, 2002, the Rules for the Implementation of Electronic Commerce, approved by the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 185 of June 02, 2016, and the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 75 of February 13, 2003.
Relations in the field of consumer rights protection are regulated by the Civil Code of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan “On Consumer Rights Protection” of April 26, 1996, No. 221-I, and other normative legal acts of the Republic of Uzbekistan.

7.1.2. The return of the goods is carried out through the Seller’s delivery service, for this it is necessary:

– inform the online store by calling the phone numbers listed in the Contacts section or by e-mail info@uzcrafts.uz ;

– print out and fill out a refund application;

– attach a product or cash receipt of the order to the return request

7.2. Goods of poor quality

7.2.1. The Buyer, upon receipt of the goods of improper quality, if the defects were not specified by the Seller, has the right to demand from the Seller (in respect of food products, the buyer has this right within 24 hours after receipt):

– replacement for the goods of a similar brand (model, article);

– replacement for the same product of another brand (model, article) with the corresponding recalculation of the purchase price;

– a proportionate reduction in the purchase price;

– immediate gratuitous elimination of defects in the product;

– reimbursement of expenses for the elimination of defects in the goods.

7.2.2. The procedure for returning the goods of improper quality is carried out in accordance with the procedure specified in paragraph 7.1.2.

7.2.3. The application for return must indicate which defect contains the goods returned by the Buyer.

7.3. Refund of funds to the Buyer

7.3.1. To return funds to the bank card, the Buyer must fill out the “Application for a refund”, which is sent at the request of the Seller to the Buyer’s email address, and send it along with a copy of the passport to the address: info@uzcrafts.uz. The refund will be made to the Buyer’s bank account specified in the application within 10 (ten) banking days from the date of receipt of the” Application for a Refund ” by the Seller.

8. Payment methods.

8.1. The Buyer can make the payment in the following ways:

– international bank cards of the payment systems Visa, MasterCard, and others;

– bank cards Uzcard, HUMO;

9. Force majeure.

9.1. Any of the Parties is released from liability for full or partial non-performance of its obligations under this Agreement, if this non-performance was caused by force majeure circumstances that arose after the signing of this Agreement. “Force Majeure” means extraordinary events or circumstances that such a Party could not have foreseen or prevented by the means available to it. Such extraordinary events or circumstances include, in particular: quarantine, strikes, floods, fires, earthquakes and other natural disasters, wars, military actions, actions of state bodies of the Republic of Uzbekistan or other States, as well as any other circumstances beyond the reasonable control of either Party. Changes in current legislation or regulations that directly or indirectly affect any of the Parties are not considered Force Majeure, however, in the event of such changes that do not allow any of the Parties to fulfill any of its obligations under this Agreement, the Parties are obliged to immediately make a decision on the procedure for eliminating this problem in order to ensure that the Parties continue to perform this Agreement.

10. Liability of the parties.

10.1. For non-performance or improper performance of the terms of this Agreement, the Parties are responsible in accordance with the legislation of the United Nations Conference on Trade and Development.

10.2. All text information and graphic images posted in the online store have a legal copyright holder, and the illegal use of this information and images is prosecuted in accordance with the current legislation.

11. Other terms and conditions.

11.1.3. The subject of the Contract and the price of the Goods.

11.2. If no agreement is reached during the negotiations, the disputes will be resolved in court in accordance with the current legislation of the United Nations Conference on Trade and Development.

11.3. The sections of the online Store explaining the terms and conditions referred to in the Offer are an integral part of this Offer.

11.4. By accepting this offer, the Buyer agrees and authorizes LLC “Craft and Art” to process their personal data, including last name, first name, patronymic, date of birth, gender, place of work and position, postal address; home, work, mobile phone numbers, e-mail address, including collection, systematization, accumulation, storage, clarification (update, change), use, distribution, transfer in the territory of the Republic of Uzbekistan, depersonalization, blocking, destruction of personal data, as well as their transfer to the Seller’s counterparties for further processing (including collection, systematization, accumulation, storage, clarification (update, change), use, distribution in the territory of the Republic of Uzbekistan, depersonalization, blocking, destruction of personal data) for conducting research aimed at improving the quality of services, for conducting marketing programs, statistical research, as well as for promoting services on the market by making direct contacts with the Buyer through various means of communication, including, but not limited to: mailing list, e-mail, telephone, fax, Internet.

11.5. The Buyer agrees and authorizes the Seller and the Seller’s counterparties to process the Buyer’s personal data using automated database management systems, as well as other software tools specially developed on behalf of the Seller. Work with such systems is carried out according to the algorithm prescribed by the operator (collection, systematization, accumulation, storage, clarification, use, blocking, destruction). Processing methods used (including, but not limited to): automatic verification of postal codes with the code base, automatic verification of the spelling of street names of localities, clarification of data with the Buyer by telephone, postal communication with the Buyer or using a contact via the Internet, segmentation of the database according to the specified criteria. The Buyer agrees that, if necessary for the purposes specified in this offer, his personal data received by the Seller may be transferred to third parties to whom the Seller may entrust the processing of the Buyer’s personal data on the basis of a contract concluded with such persons, subject to compliance with the requirements of the legislation of the United Nations Conference on Trade and Development on ensuring the confidentiality of personal data and the security of personal data during their processing by such third parties. When transmitting the specified data of the Buyer, the Seller warns the persons receiving the Buyer’s personal data that this data is confidential and can only be used for the purposes for which it is communicated, and requires these persons to comply with this rule.

11.6. The Buyer has the right to request from the Seller full information about their personal data, their processing and use, as well as to request the exclusion or correction/addition of incorrect or incomplete personal data by sending a corresponding written request to the Seller’s postal address. The consent given by the Buyer to the processing of his personal data is indefinite and can be revoked by sending a written application to the Seller to the postal address by the Buyer.
